A youth court judge in Oshawa has taken the extraordinary measure of awarding costs to a defendant, finding the Crown breached the teen’s rights by withholding information relevant to the case.
On Tuesday, Ontario Court Justice Mary Teresa Devlin ordered the Crown to pay $13,000 to cover costs incurred when additional charges were laid against a youth who had already pleaded guilty to robbery.
The teen, now 18, was shot twice by a Durham police officer responding to an armed robbery at a Kingston Rd. veterinary clinic on the morning of July 16, 2012. Court has heard the youth, who has significant mental heath issues, was intent on committing suicide when he pointed a plastic cap gun at a clinic worker and demanded euthanasia drugs.
